End User Licence Agreement - Airosyn App

1. About this agreement

This EULA is concluded between you and Airosyn only, not with Apple Inc. ("Apple") or Google LLC ("Google"). Airosyn, not Apple or Google, is solely responsible for the App and its content.

2. What the App does

• —The App pairs with and controls Airosyn diffuser hardware: intensity, scheduling and device settings.
• —The App does not require account creation or sign-in.
• —The App contains no in-app purchases and no subscriptions.

3. Licence

Airosyn grants you a limited, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for personal, non-commercial control of Airosyn diffusers, in accordance with this EULA and the applicable store's usage rules (the Apple Media Services Terms and the Google Play Terms of Service).

4. Device permissions

The App may request the following permissions, used only for the stated purpose:

• —Bluetooth — to discover, pair with and control Airosyn diffusers.
• —Local network (iOS) / nearby devices (Android) — to communicate with diffusers on your network, where applicable.
• —Location (Android) — certain Android versions require location permission to scan for Bluetooth devices. We do not use it to track your location.
• —Notifications — optional, for device status alerts.

You can withdraw permissions in your device settings. Some App functions will stop working without them.

5. Restrictions

You may not: copy, modify, or distribute the App; reverse engineer or decompile it except where law permits; use it to control hardware not made by Airosyn; interfere with its security features; or use it unlawfully.

6. Updates and availability

We may issue updates, modify features, or withdraw the App. Diffuser hardware continues to run its last-set programme independently of the App. Airosyn, not Apple or Google, is responsible for any maintenance and support of the App. Apple has no obligation to furnish maintenance or support services for the App.

7. Privacy

Data handling is described in our Privacy Policy at airosyn.com/privacy-policy. The App works without sign-in and collects only the device and diagnostic data described there.

8. Warranty and liability

• —The App is provided "as is" without warranty of any kind, to the maximum extent permitted by law.
• —In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you (the App is free, so no amount is refundable). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• —Airosyn, not Apple or Google, is responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer protection or similar legislation.
• —Airosyn's total liability under this EULA is limited to INR 1,000 or the amount you paid for the App, whichever is higher. Nothing limits liability that cannot be limited under Indian law.

9. Intellectual property claims

Airosyn, not Apple or Google, is responsible for the investigation, defence, settlement and discharge of any third-party claim that the App infringes intellectual property rights.

10. Legal compliance

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and that you are not on any U.S. Government list of prohibited or restricted parties.

11. Third-party beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance, Apple has the right to enforce this EULA against you as a third-party beneficiary.

12. Termination

This EULA is effective until terminated. It terminates automatically if you breach it. On termination, delete the App.

13. Governing law and contact

This EULA is governed by the laws of India. Courts at Mumbai, Maharashtra have jurisdiction, subject to applicable consumer protection rights.
